CooperVision Confirms Avaira® and Biofinity® Supply

Fairport, N.Y., August 26, 2009—In response to inquiries, CooperVision today confirmed that the recent ruling by a United States District Court against Johnson & Johnson does not impact the supply or the servicing of CooperVision’s customers with Biofinity® and Avaira® contact lenses in the United States or on a worldwide basis.

In the ruling, the court held that Johnson & Johnson’s Acuvue® Oasys™ spherical contact lens infringed upon CIBA Vision’s silicone hydrogel patent. CooperVision has previously entered into a license agreement with CIBA Vision whereby CooperVision has unrestricted worldwide rights under the patent asserted against Johnson & Johnson.

Biofinity and Avaira offer unique Aquaform® Comfort Science™, creating a naturally wettable, exceptionally comfortable lens for the contact lens patient. Biofinity has received approval by the FDA for extended wear.

“Biofinity and Avaira contact lenses are third generation silicone hydrogel lenses that offer premium performance and a high level of wearing comfort,” stated John Weber, president, CooperVision.
